In her lawsuit Stacy Pincus says the coffee giant is using too much ice in its drinks while overstating the fluid ounces of actual product customers are receiving.<\/p>\n<p>Stacy Pincus filed the class action lawsuit against Starbucks Corp. in Northern Illinois Federal Court Wednesday, according to court documents.<\/p>\n<p>Pincus\u2019 suit says Starbucks uses too much ice in their iced beverages and therefore customers often end up with half of the amount of drink that is listed on Starbucks\u2019 menus in fluid ounces.<\/p>\n<p>The lawsuit claims that Starbucks is adding extra ice on purpose, tricking customers into paying more for product they never receive.<\/p>\n<p>\u201cThe word \u2018beverage\u2019 is defined as \u2018a drinkable liquid.\u2019 Ice is not a \u2018beverage\u2019 by definition. Accordingly, Starbucks actually gives the customer much less beverage in the cold drinks they order and pay for,\u201d the lawsuit says.<\/p>\n<p>\u201cStarbucks\u2019 Cold Drinks are underfilled to make more money and higher profits, to the detriment of consumers who are misled by Starbucks\u2019 intentionally misleading advertising practices,\u201d the lawsuit continues.<\/p>\n<p>The lawsuit also claims that Starbucks uses much larger cups to trick customers into believing they are receiving the amount of liquid they have been promised.<\/p>\n<p>Pincus is suing Starbucks for $5 million on behalf of customers who have purchased\u00a0a cold drink at Starbucks within the past 10 years.<\/p>\n<p><a href=\"http:\/\/www.hmelegal.com\/\" rel=\"nofollow noopener\" target=\"_blank\">Hart McLaughlin &amp; Eldridge LLC\u00a0<\/a>in Chicago is representing Pincus.<\/p>\n<p>Starbucks says &#8220;ice is\u00a0essential component of any \u2018iced\u2019 beverage.&#8221;<\/p>\n<p>The company said in a statement to <a href=\"http:\/\/www.msnbc.com\/msnbc\/half-full-illinois-woman-sues-starbucks-over-too-much-ice\" target=\"_blank\" rel=\"noopener\">NBC News<\/a> that customers are more than welcome to ask that their drink be remade if they are not satisfied with the final product.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An Illinois woman is suing Starbucks for $5 million.
